Suspect wants case dismissed

MURDER suspect Joshua Garciano wants Judge Jacinto Fajardo Jr. to dismiss the murder case filed against him and his girlfriend, Resamie Cabañog, for the killing of Air Force Staff Sgt. Mark Herbert Oberes last Jan.31.

Assisted by his lawyer, Rameses Villagonzalo, Garciano asked Judge Fajardo, of the Regional Trial Court Branch 66 in Talisay City, to dismiss the case, arguing that “witnessing” the burning of a car is not a crime.

“I was made to conceal or disguise murder,” the pleading read.

Garciano and Cabanog pleaded “not guilty” to charges that they participated in the killing of Oberes last Jan.31.

Garciano and Cabanog entered their plea during their arraignment on March 7 before Jacinto Fajardo. Wearing the yellow shirts for inmates, Garciano, 22 and Cabañog, 20, were assisted by their lawyers during their arraignment.

In his pleading, Garciano said the burning of the car cannot be considered as a separate crime. So, it should be deemed “absorbed” in the murder charge pending in court.

In his resolution dated Feb. 14, Talisay City Assistant Prosecutor William Canta indicted Garciano and Cabañog for murder.

Canta said the evidence presented by the police against the respondents can be threshed out during a court trial. (GMD)
