2 face charges for neighbor’s killing

THE Office of the Cebu Provincial Prosecutor has indicted two people from Carcar City who allegedly conspired in killing a neighbor last Jan. 2, 2018.

Prosecutor Ryan Sojor found evidence to charge Allan Espinosa and Virgilio Espinosa with murder before the Regional Trial Court.

“Respondents’ (Allan and Virgilio) defenses are denial and alibi,” said Sojor in his resolution. Murder is a non-bailable offense.

The respondents allegedly shot dead Agustina Espinosa while the latter was watching over her granddaughter outside her house in Barangay Liburon, Carcar City.

It was unclear how the accused are related to the victim.

The victim’s brother, Bienvenido Panaginip, said he was in the back of his sister’s house when he heard gunshots.

He peeped and saw the accused shoot his sister, who he said was already lying on the ground. The accused then fled by on a motorcycle.

Panaginip said he rushed his sister to the hospital, where she was declared dead by physicians.

The victim sustained several gunshot wounds in her body, while her granddaughter had gunshot wounds in her back.

The accused denied the charges, saying they were somewhere else when the shooting happened.

In the resolution, Prosecutor Sojor gave weight to the testimony of the victim’s brother, who saw the shooting of his sister.

“Moreover, no ill motive was attributed to the complainant-witness to falsely charge the respondents for a serious offense,” the resolution read. (GMD)
