Suspects in robbery, rape of German charged

ROBBERY with rape charges have been formally filed Tuesday in court against the suspects who allegedly robbed and raped a German national in Bacolod City last October 2011.

Bacolod City police director Ricardo De la Paz said the three suspects are Henry Banez Jr. alias JR, 23; Cresencio Catague alias Cris, 23; and Joemar Agdana, 19, all residents of Barangay Banago, Bacolod City.

In information signed by Assistant City Prosecutor Yvone Gulmatico-Sioco, the prosecutors found reasonable ground to believe that a crime has been committed and that the accused are probably guilty. The city prosecutor also denied the bail of the three suspects.

"It's only shows that we have strong evidence against the suspects and it was established that there was conspiracy among them," De la Paz added.

De la Paz claimed that the City Prosecutor's Office also considered the confession of Agdana that prior to the incident they engaged on pot session.

Recently, the three suspects also filed criminal and administrative charges against the De la Paz and nine others before the Office of Visayas Ombudsman for Military Affairs for allegedly torturing them to make them own up to the crime.

Named as respondents in the torture raps are De la Paz; Women and Children Complaints Desk head Jovy Cabcaban; Investigation Branch head Homer Vargas; Intelligence Branch head Leonardo Borromeo; Station 3 commander Jose Mulleta; city police legal counsel Edyll Ferrera; Negros Occidental Provincial Police Office Crime Laboratory head Lazaro Sumagi; CIDG head Ernor Melgarejo, SPO1 Rosendo Bersal and PO2 Edny Matillano.
