Alejandrino fails to submit position paper

BACOLOD City Council secretary, Lawyer Nilo Alejandrino, failed to submit his position paper in the administrative case filed against him by Councilor Caesar Distrito before the Office of Vice Mayor Jude Thaddeus Sayson, despite giving him additional time to file his side of the case.
The investigating committee, composed of Councilors Homer Bais and Roberto Rojas, earlier denied the motion for reconsideration of Alejandrino to the order to submit his position paper and instead gave him an additional two days to do so, aside from the five days given to both parties to submit the said position paper.
The period lapsed last February 10 and only Distrito filed his position paper.
After the submission of position paper, both parties are supposed to submit within five days upon receipt to submit their respective comments to the position on the other party.
Alejandrino’s failure to submit his position paper was deemed by the committee as a waiver on his part to submit the same.
The investigating committee, after conducting a pre-hearing conference last January 10, and after Alejandrino's motion to resolve affirmative defense had been resolved, issued an order to submit position paper as they explained that in the conduct of admin hearings, submission of position paper is enough and sufficient.
The full-blown trial type proceeding is not required and it depends on the committee on what to do, as prescribed by the Uniform Rules in Admin Cases in the Civil Service.
