Lawyer warns city vs Barangay demolition

LAWYER Janus Jarder, counsel for some informal settlers, has thrown a hard line over the city to choose whether to demolish or to go to jail, as demolition is contrary to a national and local law.
Jarder, who spoke at RMN Saturday night, said the city could not implement a summary demolition of the structures as the residents will still file a motion for reconsideration regarding their complaint filed before the Regional Trial Court (RTC).
He also cited the city could not demolish the subject structures, as there are national and local laws that allow such during summer time.
He said such demolition did not present title and a technical description that houses are to be removed at the soonest time possible.
He added if the city will insist on the demolition, there is a possibility that they will face charges in the Ombudsman and up to the Sandiganbayan.
They will end up in jail should they insist on the demolition, Jarder warned. (Carla N. Canet)
