Court excludes voters from Brgy. 38-A A +A

A COURT in Bacolod City has issued a final decision excluding more or less 26 voters from Barangay 38, in the city.
Former Barangay 38 kagawad Emmanuel Alagao and the concerned voters complained Monday before Mavil Majarucon-Sia, election registrar of the Commission on Elections (Comelec) in Bacolod City, after they were barred from exercising their right to vote in the barangay.
Alagao and Majarucon-Sia have engaged in verbal exchanges aired live over Bombo Radyo Bacolod past 10 a.m. Monday.
Alagao has blamed the local Comelec for not informing the subject voters that they were excluded from voting in Barangay 38.
Majarucon-Sia has explained to the concerned voters that it was not Comelec that excluded them, but the court, wherein a petition was filed by kagawad Manuel Mendoza on the ground that these concerned voters were no longer residents of Barangay 38 after they were relocated to Barangay Handumanan in the previous years.
The court has conducted several hearings on this matter. Others have attended the court hearings while most of the voters failed to attend, thus their absence in those hearings have waived their rights to be heard.
The petitioner has proved to the court that the subject voters were lot awardees of the City Government after they agreed to be relocated.
Majarucon-Sia has refused to accept the blame, saying it is not the responsibility of her office to inform or notify the said voters.
The local Comelec received the court order later this month and was not able to delete or erase the names of the said voters from the certified voters list, but noted those names as "excluded" voters.
Alagao said the Comelec should have taken an initiative to inform the said voters. But again, Majarucon-Sia said the local Comelec cannot take such responsibility because it does not fall under her office.
"I cannot do a job which is not mine. It was the court that decided on that petition. Who am I to question the order of the court?" Majarucon-Sia said over Bombo radyo.
She said he local Comelec respects the constitutional right of every voter, but it does not mean that they will tolerate those who try to abuse such right.
