CLO can’t impose closure of resorts

LAWYER Cesar Beloria Jr., head of the Enforcement Unit of the City Legal Office (CLO), clarified on Thursday that their office cannot enforce the closure of the resorts in Punta Taytay, Bacolod City that were issued notices of violations by the Office of the Building Official (OBO).

Beloria said despite the violations identified by the OBO against the erring establishments, they cannot close down these resorts unless there is clear and positive recommendation to stop the operations or construction immediately.

The notices of violations issued the other day by OBO through its head Engineer Isidro Sun Jr. do not recommend any closure or stoppage order.

Issued notices were Villa Iska beach resort owned by Francis Rey Cabuga as well as Palma 1 and Palma 2, Shelton, Villarosa, Alcala, and Horizon beach resorts. A beach resort owned by a priest is also included.

Beloria said the OBO simply required the owners of the resorts to make a report within three days after receiving the notice of violation.

Meanwhile, the City Council has adopted the recommendation of the committee on laws, ordinances and good government chaired by Councilor Caesar Distrito stating that Cabuga, owner of Villa Iska beach resort, should seek the approval of the City Council regarding its Foreshore Lease Agreement application before the same will be acted upon by the Department of Environment and Natural Resources.
