Ombud junks case vs Silay City execs

THE Office of the Ombudsman-Visayas dismissed for lack of substantial evidence the administrative case for grave misconduct filed against three officials of Silay City.

Cleared by the Ombudsman were City Administrator Ignacio Salmingo, City Budget Officer Ramon Dumancas and General Services Officer Dela Ledesma from the case filed by Jose Lindy Chan and Jojo Sumiller.

The case stemmed from the direct purchase of 20,000 liters of fuel worth P768,800 from TG lubricant Gasoline Station. The complainants contended that the government suffered undue injury on the said purchase because it was allegedly overpriced at P3.32 per liter.

In a decision dated March 17, 2014, Deputy Ombudsman for Visayas Pelagio Apostol stated that the respondents acted in good faith when they relied in good faith that the Bids and Awards Committee resolution was valid.

They resorted to direct contracting due to the urgent need to purchase fuel so that delivery of basic services will not be affected by the transition of administration in the city, Apostol said.
