Mayor ordered to comment on mandamus case

THE presiding judge of the Regional Trial Court Branch 54 has ordered Bacolod City Mayor Monico Puentevella to file his comment within ten days after receiving the copy of the mandamus case filed by AVM Bernardo Engineering.

Puentevella is accused of withholding the mayor's permit of the AVM Bernardo Engineering despite the company’s compliance with the documentary requisites and payment of the regulatory fees.

The AVM, operator of the city’s slaughterhouse, filed the case last August 12.

“The petition of AVM sufficient in form and substance thus the respondent is directed to file his comment,” Judge Eduardo Sayson’s order stated.

The petition stated that “(t)he foregoing acts of Puentevella brought on the AVM material and moral deprivation thus seriously threatens the propriety rights and interest of the petitioner.”

Glorydee Cometa, AVM plant manager, said they started processing their permit on January 2, 2014 and despite the recommendation of Atty. Cesar Beloria of the City Legal Office to issue the permit, the Office of the Mayor continued to withhold it. [Read the related story.]

In his recommendation, Beloria stated that the business permit application of AVM should be approved and released as there is no cogent and lawful ground to hold or restrain the same.

Puentevella earlier said the AVM could no longer get their business permit because he believes that the slaughterhouse operator has violated the provisions of its contract. (CNC)
