THE Baguio Regional Trial Court branch 61 recently meted a life term and a P5 million fine for a father and son who maintained and operated a drug den along Siapno Road.
The Baguio drug court in its recent decision convicted Theodulo “Teddy” Villareal and son, Peter John Villareal, for converting their house into a drug den, “a place where illegal drug activities abound” the court decision said.
“But what this Court condemns the most is the presence of minors inside the drug den operated by Theodulo Villareal and Peter John Villareal and that a son of Theodulo, a minor, and whose name will not be mentioned here, was even tested positive with THC-Metabolites or marijuana by the PNP Crime Laboratory,” Branch 61 presiding Judge Antonio Reyes said.
“This Court, without the slightest hesitation, finds the accused guilty as charged for the maintenance of a drug den,” the decision stated.
The Philippine Drug Enforcement Agency reported the drug case stemmed from an implementation of search warrant at the Villareal residence on August 2, 2008 by combined operatives of the Criminal Investigation and Detection Group and Philippine Drug Enforcement Agency then led by then Police Inspector Jerry Fernandez and Police Officer 2 Gil Cesario Castro who is now the Assistant Regional Director of PDEA – CAR.
“The filing of multiple cases including maintaining drug den under Section 6 of Republic Act (RA) 9165 was a test case for drug den case. In series covert operations, we would be able to build the case against the Villareals, and as far as I can remember, this is the first conviction for Section 6. We are elated by the decision of the court,” assistant regional director Castro said.
PDEA regional director Ronald Allan Ricardo also welcomed the court decision claiming “that justice triumphs when collective efforts from stakeholders are consolidated.”
Thodulo Villareal was also found guilty of marijuana cultivation and was meted out with another life term and P5 million penalty in the same 16-page decision by Judge Reyes last December 2 further ordering him to be transferred to the national penitentiary in Muntinlupa.
Meanwhile, in La Trinidad, Benguet, local courts sentenced Nicanor Dayaoen to life imprisonment December 2 and P500,000 in fines in a ten-page decision by Judge Agapito Laoagan Jr. of the First Judicial Region’s RTC Branch 64 in Abatan, Buguias.
Dayaoen has been in the target list of drug personalities in region before he was collared by PDEA agents.
Laoagan in his decision found the accused guilty beyond reasonable doubt in violation of the Comprehensive Dangerous Drugs Act.
Laoagan ordered the drugs found on the arrest of Dayaoen to be destroyed “to prevent use.”
In 2010, Dayaoen was busted at Abatan, Buguias, when he sold shabu in a heat-sealed, transparent, plastic sachet, for a thousand pesos, to a PDEA agent who acted as buyer in the anti-drug operation.
PDEA has recently also collared leaders of the Olsim group operating in the province capital in a bid to cripple the growing industry of illegal drugs here.
The agency has also cracked down on Sagada town, closing down several drug dens known to dispense marijuana, giving the town the moniker, Amsterdam of the North. (with Maria Elena Catajan)
