Philex stands firm on dues

LA TRINIDAD, Benguet -- Philex Mining Corporation stands firm in its decision in tax payments for Itogon and Tuba towns.

Philex Vice President for Operations and Padcal Mine Resident Manager Libby Ricafort, in a letter to both Mayors Victorio Palangdan and Florencio Bentrez of Itogon and Tuba said, "We reiterate and re-emphasize our previous firm and consistent position, as contained in our earlier letters."

Weeks ago, both towns penned a joint resolution agreed to collaborate efforts to collect from Philex Mining Corporation P1,361,451,514.11 representing business taxes unpaid since 2002.

The amount is a result of a joint assessment of both towns' treasury offices, consolidating both areas computations piled over the years.

The joint resolution signed by members of the council of the towns said efforts to ask the mining company to pay failed while alleging Philex is exploiting the boundary dispute between Itogon and Tuba.

Ricafort detailed conditions of payment for alleged back logged business taxes for both highland towns citing four requirements; first, the settlement of the boundary dispute between Itogon and Tuba, second, valid and legitimate tax measure imposition and third, a valid and legitimate tax assessment.

The joint resolutions added the boundary dispute between Itogon and Tuba has taken its place in the history of these local government units and yet for over 50 years saying no formal cases has been filed in court because of principles of amicable settlement in the highlands.

In the past, the company has urged both towns to settle their boundary disputes for a tax settlement to ensue as the company can only start to compute the taxes due to both municipalities when a definite host community is determined by courts.
