DENR: Cases against lawmaker distinct

THE Department of Environment and Natural Resources (DENR) in Cordillera clarified the three cases filed against Baguio City Representative Nicasio Aliping Jr. for undertaking a road construction in his property in Mt. Kabuyao are different from each other.

Regional Director Pacquito Moreno told the media in response to Aliping's reason of resetting the technical conference with the Environmental Management Bureau scheduled July 18.

Aliping explained matters to be undertaken in the meeting may affect the resolution of the case filed against him by the DENR, which is now pending at the Benguet Provincial Prosecutors Office.

He even requested resetting of the technical conference "until such time that the case has been resolved".

Moreno, however, said, "I am no lawyer, but the way I understand it, the Clean Water Act is different from the PD 705 (Philippine Forestry Code) and Environmental Impact Statement System Law".

The director believes the technical conference may be pursued without affecting the pending case filed by the DENR.

He also said the DENR will not pull out the case against Aliping and contractors Goldrich Construction, RUA Construction and BLC Construction and Aggregates for violation of the Philippine Forestry Code.

Meanwhile, EMB OIC Regional Director Oscar Cabanayan also maintained the matter with the DENR's PD 705 is indeed different from the Presidential Decree 1586 or the Environmental Impact Statement System, which is under their watch.

The EMB will no longer wait for Aliping's case with the DENR to be resolved.

According to him, the technical conference will push through with or without his presence second week of July.

He said they will have to make a decision even without the solon's presence.

The Baguio Water District before the Pollution Adjudication Board recently filed another complaint June 26 against Aliping and the contractors.

The criminal charges were based on the violations of the Clean Water Act.
