MANILA (Updated 1:40 p.m.) -- A supplier of fruits and vegetables to high-end hotels in Cebu was slapped with P5.6-million worth of tax evasion case before the Department of Justice for understating dues to the government in 2005.
The Bureau of Internal Revenue (BIR), which filed the case on Thursday, said Araceli Bagasbas-Duhaylungsod only declared P182,500 in gross receipts for 2005 despite having received a total of P7.53 million from Mactan Shangri-La, Waterfront Cebu City Casino Hotel and Waterfront Mactan Casino Hotel.
Duhaylungsod is the owner of Angelland Fruits and Vegetables and Angelland General Merchandise located at Alley No. 4, Borbajo St., Talamban, Cebu City.
In coming up with the case, the BIR informed Duhaylungsod of her tax discrepancies for 2005 and sent access letters to withholding agents and payors, including Mactan Shangri-la Hotel & Resort Inc.
Specifically, the BIR asked for the 2005 schedule of gross income payments to Duhaylungsod and her company, and photocopies of 2005 official receipts or sales invoices she issued to clients.
After evaluation and comparison of the gross sales or revenues declared by Duhaylungsod in 2005, as against the sales she made according to third party information, the BIR discovered that she deliberately failed to declare her correct tax base by substantially under-declaring her income on that year.
Duhaylungsod may be fined and jailed if found guilty of the charges. (Virgil Lopez/Sunnex)
