Napoles' brother petition to stop arrest goes to CA 7th Division-A A +A
Tuesday, September 3, 2013
THE Court of Appeals Seventh Division was tasked on Tuesday to rule on the petition filed by the brother of alleged pork barrel scam mastermind Janet Napoles in connection with the arrest warrant issued against him for supposed illegal detention of whistleblower Benhur Luy.
Associate Justice Noel Tijam, the division's chairperson, was assigned to study and write the court's decision on the petition of Reynald Lim, who has yet to surface because he believes that the Makati City Regional Trial Court branch 150 was unfair for not hearing his motion for judicial determination of probable cause regarding the complaint filed by the Department of Justice (DOJ).
Joining Tijam in the division are Associate Justices Romeo Barza and Ramon Cruz.
Lim asked the CA to stop the National Bureau of Investigation (NBI) and other law enforcement agencies from hunting him by recalling the arrest order issued by Judge Elmo Alameda on August 14.
The government is ready to give P5 million to anyone who can provide information leading to his capture.
Napoles surrendered to President Benigno Aquino III last week and is currently detained at Fort Sto. Domingo in Sta. Rosa, Laguna.
She will be arraigned for the same crime on September 9. (Virgil Lopez/Sunnex)
