Napoles couple absent from tax case hearing-A A +A

ALLEGED pork barrel scam mastermind Janet Napoles and her husband, Jaime, failed to attend the first hearing of their tax evasion case at the Department of Justice (DOJ) on Monday.
Senior Assistant State Prosecutor Edna Valenzuela said the DOJ is giving the couple until November 5 to personally submit their counter-affidavit.
According to lawyer Romeo Villarta III, representative of the Napoles couple, his clients will submit their counter-affidavit but the composition of the defense team is not yet complete.
Janet Napoles is now detained at the Fort Sto. Domingo, Sta. Rosa Laguna for the separate case of serious illegal detention filed by pork barrel scam whistleblower Benhur Luy.
"We sent a subpoena to the Fort Sto. Domingo, so it's up to the one holding custody there whether to allow the respondent Napoles to appear before the DOJ," Valenzuela said.
She added that the Fort Sto. Domingo officials have not yet replied to the subpoena.
"Wala pa. Kapag pinadalhan namin sila ng subpoena, lookout na nila 'yun kung aatend sila o hindi. What matters is we gave them the opportunity to be heard and to submit the pleadings in their defense," she said.
The Bureau of Internal Revenue filed the tax case against the couple in September for violations of the National Internal Revenue Code. Janet is liable for seven taxable years amounting to P44.68 million, while Jaime Napoles is liable for six taxable years amounting to P16.43 million.
Jean Napoles, daughter of Napoles couple, is also facing a P32.06 million tax evasion case. (Sunnex)
