Probe into death of child who was denied hospital entry sought

SENATOR Nancy Binay sought Tuesday a probe into the alleged refusal of a hospital in Butuan City to admit 10-year-old Jannary Chan, leading to her death.

Chan was suffering from congestial heart failure, diabetes and kidney problem when she was rushed to Butuan Doctors Hospital. But she was denied entry by the hospital because her family cannot pay the P30,000 demanded by the hospital.

“It has come to my attention through personal meetings that patients in hospitals not staying in private rooms are being detained against their will," Binay said, author of Senate Resolution 837.

“That practice (of the hospital) is unjust and there are laws which stated that the hospital should not reject patients with critical condition,” she added.

Citing the Constitution, Binay said Congress must give priority to measures that "protect and enhance the right of the people to human dignity, reduce social economic and political inequities."

The senator quoted Republic Act 8344 Section 1, which states that it is unlawful for a hospital to demand any deposit for confinement or to refuse to administer medical and support in emergency cases.

Section 1 of Republic Act 9439, meanwhile, disallows the detention of patients for reasons of nonpayment in part or in full of hospital bills or medical expenses.

“These are the laws on healthcare in the country and yet, it seems that the Department of Health (DOH) has been lax in ensuring that hospitals comply,” Binay said.

Binay is urging the DOH to monitor the implementation of their policies to all hospitals in the country. (Sunnex)
