No stay order on Napoles’ trial at Sandiganbayan

MANILA -- Alleged pork barrel scam mastermind Janet Napoles will remain on trial for plunder and graft at the Sandiganbayan.

In its en banc session on Tuesday, the Supreme Court (SC) decided to require the Sandiganbayan and the Office of the Ombudsman to comment on Napoles' petitions for certiorari within 10 days.

The Court also gave the same amount of time to the Ombudsman and the Sandiganbayan to respond to the petitions lodged by Napoles' daughter Jo Christine and nephew Ronald John Lim.

Both questioned their indictment in the cases involving the alleged misuse of the Priority Development Assistance Fund (PDAF).

Napoles said in her petition that the Ombudsman committed grave abuse of discretion for finding probable cause against her for plunder, a non-bailable offense, despite "the clear absence of the element of 'amassing ill-gotten wealth for an accused public officer'."

She also denied links to the several fake non-government organizations (NGOs), which were allegedly used as beneficiaries of the PDAF allocation of detained Senators Estrada, Juan Ponce Enrile and Ramon "Bong" Revilla Jr.

These senators supposedly got multi-million peso kickbacks from Napoles for funneling their PDAF into the bogus foundations.

Napoles, also on trial for the alleged serious illegal detention of whistleblower Benhur Luy, is currently detained at Camp Bagong Diwa in Taguig City. (Sunnex)
