Son asks CA to order release of Bolante (5 p.m.)

MANILA — The son of former agriculture undersecretary Jocelyn “Joc-Joc” Bolante filed Monday a petition for habeas corpus, asking the appellate court to order the release of Bolante from Senate custody.

According to a television report, Owen Vincent Bolante petitioned the Court Appeals (CA) to direct the Senate sergeant-at-arms to bring his father to the appellate court from St. Luke’s Medical Center where the former agriculture official is undergoing medical tests and treatment.

Bolante’s son said the Senate’s warrant of arrest, which was issued last December 2005 by the 13th Congress, is no longer valid. He added that the move of the Senate to take custody of his father was illegal.

The older Bolante was tagged as the mastermind in the P728-million fertilizer fund scam in 2004. He was brought to St. Luke’s Medical Center upon his arrival from the US last week. He was also shown a copy of the arrest order while at the Ninoy Aquino International Airport (Naia) last Tuesday. (Sunnex)
