Civil Service orders Emano to reinstate 3 workers

THE Civil Service Commission (CSC) has ordered Cagayan de Oro City Mayor Vicente Emano to immediately reinstate three employees of the City Government to their original positions with payment of back salaries covering their illegal reassignment.
In a resolution dated February 1, 2013, the CSC granted the motion for Execution of CSC Decision 12-0126 reinstating Ricardo Valerio, Dennis Naïve and Melchor Luna to the Roads and Traffic Administration (RTA) with their corresponding positions before they were illegally reassigned to other posts, reversing and setting aside Emano’s detail and reassignment orders in 2010.
Valerio and Naïve resumed their posts on Tuesday and were to receive their salaries and benefits.
Lawyer Rey Raagas said the CSC has also directed the regional office to monitor its implementation and is only given five days from receipt to make a report of compliance.
Raagas said non-execution of the said resolution by Emano can result in administrative and criminal liability under Section 21, Rule 24 of the Revised Rules on Administrative Cases.
“Pwede siyang ma-charge usab og anti graft and corrupt practices,” Raagas said in a radio interview.
Valerio was hired by the City Government as engineering assistant on April 19, 1999, but was transferred as chief for field traffic operation under the RTA on April 19, 2005.
On February 20, 2006, Valerio was ordered to report to the head of the security services and was assigned to do the “menial and humiliating task of opening and closing the gate of the City Hall parking area” and was then ordered to report to the Office of the Punong Barangay in the hinterland village of Baikingon on July 9, 2010.
Luna was reassigned by Emano at the hinterland of Barangay Mambuaya as a traffic officer and had been an administrative aide VI and RTA supervisor before his transfer.
Naive was originally appointed as Mining Claims Examiner 1 under the City Environment and Natural Resources Office (Cenro), but was transferred to the RTA as Administrative Officer 1.
On July 9, 2010, Naive was detailed at the City Health Office where he was assigned as office guard, but was transferred on August 11, 2010 upon Emano’s order to Barangay Tumpagon as watchman in a public elementary school.
