THE 60-day temporary restraining order (TRO) issued by the Court of Appeals (CA) granting Cagayan de Oro City Mayor Oscar Moreno, City officials lawyer Percy Salazar, and Beda Joy Elot reprieve following an order of the Office of the Ombudsman suspending them for three months for an anomalous sports program in 2013 will expire Tuesday, October 4.
Lawyer Dale Mordeno, head of Moreno's legal team, said Moreno’s camp is now waiting for the CA to issue a writ of preliminary injunction so that no further action can be taken against Moreno while the case is still being resolved.
"Ato lang iagi ni tanan sa legal channels aron dili pud ma-hamper ang atong basic services sa siyudad," Moreno said.
It can be recalled that the Ombudsman found Moreno, Salazar, and Elot guilty of simple misconduct and were ordered suspended for three months without pay for implementing a contract for the “Sports Development Program for Professional and Amateur Boxing” without getting authorization from the City Council.
Records showed that in 2013, the City Government disbursed a total of P175,000.00 in rental payments for a lease contract that had no prior authority from the Cagayan de Oro City Council.
“Moreno did not secure authority from the Sangguniang Panlungsod (City Council) before entering into a contract in blatant disregard of the provisions of the Local Government Code,” the resolution read.
The complaint was filed by Puntod barangay chairman Marvin Beja in 2013.
City Councilor Leon Gan said during the City Council session Monday that City Vice Mayor Rainier Joaquin Uy should be ready to take over following the expiration of the CA’s 60-day TRO.
"We must be prepared, if in case after 5pm tomorrow, there will be no preliminary injunction issued, you (Kikang) will sit as Mayor. But the second question is, if that happens, who will be the Vice Mayor now?" Gan said.
Uy, however, declined to comment on Gan’s suggestion saying only that he is prepared to serve the people "no matter what may come".
