Real estate firm offers legal service

ANTICIPATING the need for legal services to accompany real estate transactions, property rental service company Rent.ph has partnered with three lawyers whose expertise is in handling real estate issues.

Among them is a Cebuano based in California, Alberto Montefalcon Jr. With Americans opting to invest in real property in the Philippines, Montefalcon believes his services will come in handy in aiding investors acquire property and have these rented out. Aside from foreigners, Montefalcon said former Filipinos who have become naturalized American citizens may also wish to thresh out legal issues to allow them to acquire property.

Local attorneys Joyce Adlao and Jack Amores will also be on hand to assist Rent.ph’s clients.

Since Rent.ph offers a wide array of services, from buying, renting, leasing and property management, its president Antonio Leuterio said they also wanted to be able to partner with lawyers to help their clients.

Legal issues

As Cebu’s property sector booms, managing director Chris Malazarte said they expect litigation to follow and that by partnering with the lawyers, they can be prepared to face legal issues.

He added that they would rather leave the legal aspects to the experts and offer their clients the peace of mind of having such services available.

He said the lawyers they have chosen were exposed to the field of real estate and are familiar with the industry.

Montefalcon practiced law in the Philippines before relocating to the US. While waiting for his bar card, he earned a realtor’s license and sold property.

Like Montefalcon, Amores was a real estate broker before he took the bar exams.

Adlao, of Baquiano and Associates, started in civil and criminal litigation, but admitted that practicing in the Philippines makes lawyers try out other fields, which led her to handling real estate issues.

Avoid litigation

Amores told reporters that lawyers are not only called upon when litigation arises, but ensure that all transactions are in order to avoid arriving at litigation.

He said that in any transaction, clients should be made aware that litigation should be the last resort. Lawyers, he said, help clients exercise due diligence in purchasing real property.

“It is best for us to apply preventive lawyering so there will be no future conflicts,” he told reporters.

Montefalcon added that they represent the “new breed of lawyers” who avoid litigation as much as possible.

For Malazarte, the partner lawyers are not just resource persons for investors, but for agents as well.
