I.Protect: Telescoped trademarks

TELESCOPED trademarks are those that comprise two or more words that share letters.

The frequently-cited examples of these are: VITAMINSURANCE, ORDERECORDER, HAMERICAN, POLLENERGY, and SUPERINSE. Telescoped words are registrable as trademarks – subject to the same requirements for trademark validity. Thus, a telescoped mark must not merely be generic to the goods or services that it covers, or it must not simply be descriptive of the qualities of the said goods or services. If a word in the telescoped mark is generic or descriptive, this must be disclaimed. When a word is disclaimed, it still forms part of the entire trademark. The only effect of a disclaimer is that the trademark owner does not have monopoly over the disclaimed word or feature.
