A COURT has ordered the release of an alleged member of a robbery gang involved in various heists in the country after no complainants showed up during trial.
Regional Trial Court (RTC) Branch 16 Judge Sylva Aguirre-Paderanga provisionally dismissed the robbery with homicide case against Noel Salig Davis last Thursday.
Difficulty
Davis, known by hi alias Isyot, was linked by the police to a number of robberies in Manila, Cebu and Mindanao.
“Finding the joint motion of both the prosecution and the defense well-taken because it is the public prosecutor who is encountering difficulty in locating the whereabouts of the prosecution witnesses of this case, and in order to unclog the heavy docket of this court,” said Paderanga in her order.
An earlier report said his group was involved in the robbery of the Oro Sugbo Pawnshop on Magallanes St., Cebu City in May 2008, GP Dental Supply in Raintree Mall on May 2009, and a jewelry dealer, where he took almost P6 million in Barangay Labangon, in July 2009.
The police further said the group was the one who robbed the Union Bank in Alabang, Manila last Sept. 14, where three security guards were wounded and one of the suspects shot dead.
Bukidnon
They were also involved in the robbery in Maranag Bukidnon last Sept. 5 that killed one policeman.
Davis was arrested by the personnel of Police Regional Office (PRO) 7 Regional Intelligence Division in Sitio Mangga, Barangay Kadapman, Ozamiz City last Sept. 26.
