FORMER Barili councilor Joel Villaflor will face trial in court for his alleged failure to return government properties in 2007.
The Office of the Ombudsman Visayas found evidence to indict Villaflor for malversation of public properties.
Villaflor is accused of not turning over a .45 pistol worth P33,100 and a laptop notebook valued at P42,450.
“The failure of respondent to return these items at the termination of his term creates a presumption that there was taking or misappropriation of those properties for which he was accountable,” read the resolution of Graft Investigator Michael Menardo Jr.
Villaflor’s indictment came after he failed to submit his counter-affidavit.
Barili Mayor Teresito Mariñas filed the criminal case against Villaflor at the anti-graft office last Oct.17, 2012 yet.
In his complaint, Mariñas said he ordered the town treasurer to conduct an inventory and accounting of all the properties owned by the Municipal Government.
The town treasurer discovered that Villaflor failed to return the firearm and laptop issued to him during his incumbency.
A letter was issued to Villaflor demanding the return of the properties, but to no avail.
The ombudsman also directed Villaflor to submit his counter-affidavit, but he still failed to comply with the order.
In the resolution, Menardo said Villaflor’s failure to submit his counter-affidavit constitutes a waiver of his right to refute the charges against him.
“The pieces of evidence presented by the complainant being uncontroverted, the same are deemed sufficient to establish that a crime of malversation of public property may have been committed and the respondent is probably guilty thereof,” the ombudsman said.
