MTCC rules ‘losing candidate’ beat rival by 176 votes

THE Municipal Trial Court in Cities (MTCC)-Lapu-Lapu City has declared the winner the losing candidate for barangay captain in last October’s election in Punta Engaño.

According to the decision of MTCC Judge Francisco Garciano, former barangay councilor Diosminda Hayashi edged out her rival Lourdes Ibag by 176 votes.

Hayashi filed an election protest last November.

The ballots were recounted the following month.

Atty. Rilven Virtudazo, Hayashi’s lawyer, said his client garnered 1,601 votes, while Ibag got 1,425, based on the court decision.

Virtudazo said they are grateful the real winner has finally been revealed.

Deadline to appeal

Hayashi, in a separate interview, said her rival has five days to appeal.

If Ibag fails to meet the deadline, the court will come up with the date Hayashi will assume the post.

Hayashi was with relatives and supporters when she went to the court for the promulgation.

She said she was expecting the victory after she learned she garnered more votes during the recount.

Sun.Star Cebu tried to contact Ibag for her comment, to no avail.
