Lawyer: Baby’s mom wanted peace of mind

THE mother of the newborn whose mouth was allegedly taped by staff at the Cebu Puericulture Center and Maternity House (CPCMH) nursery wanted to have peace of mind, the hospital’s lawyer said.

Lawyer Cornelio Mercado yesterday said Jasmine Badocdoc sought a settlement with the hospital so she can put the issue behind her.

Badocdoc, however, has denied signing a settlement agreement with CPCMH. She said the signature that appeared on the June 27 document is not hers.

Mercado presented a voucher and a check for P15,438.75, both bearing Badocdoc’s supposed signature. The check was marked “paid.”

The hospital’s lawyer said Badocdoc communicated with CPCMH chief nurse Elena Jumao-as regarding the settlement. The document states that Badocdoc entered into the agreement not because of money.

Mercado said Badocdoc told hospital officials she was having domestic issues with Ryan Noval, the father of her child. He did not elaborate.

Noval and Badocdoc are not married.

Mercado said that during the June 27 meeting with CPCMH Board president Florencia Streegan, board member Dr. Iris Jakosalem, Jumao-as and another official, Badocdoc said she was going to return to her hometown in Samar.

Mercado said the hospital decided to grant Badocdoc's request for financial assistance because they were moved by her story.

He said the hospital did not record the proceedings of the meeting because they did not know Badocdoc would deny it later.

“It was done in good faith and we never suspected her. Recording the proceedings only leaves a bad taste in the mouth,” Mercado said.

In a text message to Sun.Star Cebu, Noval said they will discuss the latest development with their lawyer Haide Orbiso.

He said the alleged settlement will “slightly affect” their main case against the hospital but Orbiso and another lawyer are studying it.

He challenged the hospital to prove the settlement took place. “Where is the money?” he asked.

Sun.Star Cebu was unable to get Orbiso's comment.
