NBI 7 arrests ‘rapist’

“I WILL marry her.”

This was the promise of cellular phone shop employee Jimmy Barnedo Agatis to a 23-year-old woman from Cagayan de Oro City whom he allegedly raped, after he was caught by a team from the National Bureau of Investigation (NBI) 7 inside a mall in Cebu City yesterday afternoon.

Special investigator Larry Dominguez said Sara (real name withheld) complained that Agatis, 25, raped her inside a lodge on Colon St. last Thursday dawn.

Agatis, who hails from San Carlos City, Negros Occidental, said Sara is his girlfriend and she voluntarily went with him.

Sara denied this, said Dominguez.

Last Tuesday afternoon, Agatis said he met Sara inside the mall where he was arrested by NBI agents.

Drinks

He befriended Sara and the two drank beer inside a resto bar on Gen. Maxilom Ave. the following night.

"She did not get drunk," said Agatis.

He said he asked Sara to kiss him, but the latter refused because they were in public. So he convinced her to go to a "private place."

Both rode a taxi and checked in at a lodge last Thursday around 1 a.m.

Afterward, Agatis said he told Sara, “I really want to marry you.”

Sara, he said, did not agree because she was afraid her older sister would get mad at her.

They left the lodge an hour later to bring Sara to the Cebu City Medical Center because she was bleeding. She was transferred, though, to Vicente Sotto Memorial Medical Center for treatment.

During his interview with the victim, Dominguez said Sara went with Agatis thinking he would accompany her in going back home.

Sara said she got drunk because she was not used to drinking alcohol.

"She was very weak. She was not able to resist the suspect's advances on her," said Dominguez.

He said they will charge Agatis with rape, a violation under the Revised Penal Code, before the Cebu City Prosecutor's Office. KAL
