Complaint filed vs. dad

THE parent of a football player filed a complaint for violation of anti-child abuse law against a Sacred Heart School-Ateneo Cebu (SHS-AdC) parent at the Mandaue City Prosecutors office yesterday.

It was supported by affidavits of parent-witnesses and a supporter, who also saw the suspect allegedly pound the head of the victim.

Rodnel Anoba Benolirao Sr., on behalf of his 16-year-old son, filed a complaint against Enrico Mongaya, alleged father of one of the football players of SHS-AdC, for violation of Republic Act 7610.

“I was surprised something very hard struck my head that caused too much pain, while I was on the ground,” said the football player in his affidavit. He later identified the man who hit his head as Mongaya.

“I saw Enrico Mongaya hit the head of of the victim, using a Swiss knife,” one of the witnesses, 22-year-old Retchie Carulasan Arias, stated in his sworn affidavit.

Dierdre Arias, 40, a school teacher and elementary football coach, who was also watching the game-turned-brawl, also stated in her affidavit that she saw Mongaya pound the head of the Alcoy player.

She stated in her affidavit that upon seeing the fight between the Alcoy player and the that of Ateneo, she immediately told her nephew, Retchie Carulasan Arias, to stop the fight. Arias ran toward the two, but Mongaya came in first.

“But Mongaya tried to punch him (Arias),” Dierdre stated.

Seeing Mongaya about to punch him, Arias, in his affidavit, said he told Mongaya that the Alcoy player is already bleeding.

Upon seeing the bleeding victim, Arias stated that Mongaya left the game and did not return.

The brawl erupted during the football match between Alcoy Football Club, where the complainant the goalkeeper, and SHS-AC.

Dierdre, in her affidavit, quoted football players’ parents of SHS-AC telling them, “Mga pobreng taga bukid nganong nag-apil-apil pa mo sa among duwa? Balik na lang mo didto sa inyo.”

Couple Paramon and Anecita Osorio bolstered other witnesses’ statements, as they also saw Mongaya pound the head of the victim. Ma. Teresa Fuentes and the Osorios also executed affidavits to support the complaint against Mongaya.

The Provincial Women’s Commission (PWC), who assisted the complainant and parent in the filing of case against Mongaya also submitted yesterday a photocopy of the blotter report of Mandaue Police Station 2 regarding the brawl that erupted last March 16, 2014. It also a submitted medico legal certificate issued to the complainant by the Mandaue City District Hospital and initial psychological evaluation report issued to the victim by Women and Children-Friendly Center of Don Vicente Sotto Memorial Medical Center.

The complaint, affidavits of witnesses and supporting documents were notarized by Mandaue City Prosecutors Office as complainants will return today for the final process.

Sun.Star Cebu tried to contact Mongaya for his side and was asked to contact his lawyer for his statement.

Atty. Ram Villagonzalo did not reply to Sun.Star Cebu as of press time last night.
