GIPALINGKAWAS sa korte ang gipasanginlang maoy ningtulis sa Landbank of the Philippines (LBP) Bogo human way nakitang lig-ong ebidensya nga naglambigit kanila sa pagtulis sa usa ka kooperatiba duha na ka mga tuig ang nakalabay.

Sila si Joel Sumabong ug Efren Beladas giabswelto ni Regional Trial Court (RTC) Judge Gabriel Ingles kagahapon sa kasong pagtulis sa Cebu People’s Multi-Purpose Cooperative sa Barangay Talamban niadtong Enero 3, 2007.

“Accordingly, for insufficiency of evidence accused Joel Sumabong and Efren Beladas are acquitted,” nagkanayon si Ingles sa iyang duha ka pahina nga kamanduan.

Ang prosekusyon nipresentar og tulo ka mga testigo nga pulos mga empleyado sa kooperatiba.

Way bisan usa kanila ang nakatumbok nga sila si Sumabong ug Beladas maoy nanulis.

Hinuon, ilang naestablisar nga aduna gyoy pagpanulis apan way ebidensya nga ang duha may naghimo sa krimen.

“While this Court strongly doubts the uniform claim of said witnesses that they personally witnessed the robbery but did not see the perpetrators thereof, this Court cannot compel them, through cross examination, to state otherwise as it will then be suspected of impartiality which is violative of the right of the accussed to due process,” dugang padayag sa kamanduan.

Nitataw ang korte nga usik kaayo ang panahon ug paninguha sa mga nalambigit nga habig ning kasoha.

“Not only did it waste the time and effort of all parties concerned (the police, the prosecution, this court and even the accused) more importantly, it is the best way to encourage criminality and even a repetition of the same crime against the cooperative concerned, the private complaints and victims themselves,” dugang padayag sa korte.
