PROSECUTOR Victor Sepulveda said he has yet to receive a counter-affidavit from members of Tau Gamma Phi and Tau Gamma Sigma accused of killing a neophyte in August.
"Whether they will submit their counter-affidavit or not, under the rules, I am given 60 days to resolve the complaint," Sepulveda told Sun.Star Davao, adding that the case was assigned to him in October 22 and issued the subpoena on the accused days after.

The respondents, Junavie Cagas, Dan Sayman, Edsil Basadre, Ricky Benagua, Ritchie Ryan Bodiongan, Rayburn Adante, Rolan Julius Titan, Aljon Almerol, Danny Milagrosa, Jeff Bryan Maquiling, Jacky Jay Masaling, Pablito Manco Jr., alias Karla Gonzales, Hermilo Mahumoc, Johnson Presente, Glenn Mark Tablate, JR Osais, Redel Realse, and 17 unidentified members were charged with violation of Republic Act (RA) 8049, otherwise known as the Anti-Hazing Law.
The victim, Carl Anthony Gaudicos, an 18-year-old Engineering student at Holy Cross of Davao College, died during initiation rites conducted by the fraternity members for those who want to join the group.
The incident happened around 1 p.m. on August 21 in Purok 4, Barangay Ilang, Bunawan District. (RMH)
