SSS backs out from case vs 5 school owners

THE Social Security System (SSS) filed a motion to withdraw the case filed against five owners of a school in the Island Garden City of Samal who allegedly failed to remit more than P300,000 worth of members' contribution.
Eileen dela Cruz, SSS Davao accounts officer, submitted an affidavit of desistance before the Regional Trial Court (RTC) branch 15 on February 2.

"Considering that we cannot prove this case without the testimony of the private complainant brought about by its apparent hostility to testify, this case cannot be proved beyond reasonable doubt," part of the motion read.
Mary Anne Cervantes, Anita Villarica, Priscilla Cadena, Nenita Balbin, and Carlos Cervantes, officers of Holy Name School Foundation Inc., were previously charged with violation of the SSS law after they failed to remit to SSS the contributions of their employees worth P349,621.87, including the three-percent penalty computed as of August 2, 2010.
Previous records showed that the respondents did not remit contributions from October 2005 to March 2006, June 2006 to March 2007, July 2007 to March 2008, June 2008 to March 2009 and June 2009 to July 2010.
Dela Cruz in her motion to withdraw criminal information said the school owners have already complied with the necessary documents and requirements.
