Former tourism official appeals estafa raps

A FORMER city tourism official is set to file a motion to quash the information regarding a case filed against him in March 2011 by acting Davao City administrator.
Oscar Casaysay, through his counsel Neil Cariaga, will file a motion to quash the information before the Municipal Trial Court in Cities (MTCC) branch 2 on the estafa case filed by Davao City acting administrator Zuleika Lopez.

Casaysay earlier filed a motion for reconsideration before the City Prosecutor’s Office (CPO) for filing the case without conducting any preliminary investigation.
Prosecutor Gaye Magdagasang, in her resolution, said no preliminary investigation is required.
MTCC branch 2 acting presiding judge Carfelita B. Cadiente-Flores, in her order dated February 1, has given the defense 10 days to file the motion to quash.
Flores also cancelled the arraignment of the accused on the same day.
Court records showed that Lopez sued Casaysay for allegedly failing to return her passport worth P1,500, misappropriating and converting it to the personal use of the accused.
The incident happened sometime in September to October 2010.
