Man gets jail for hacking neighbor-A A +A

THE Regional Trial Court (RTC) sentenced a 71-year-old man to ten years in jail after he withdrew his not guilty plea and admitted the crime of hacking to death his neighbor in Paquibato District.
Records from the RTC Branch 14 showed that the court found Emilio Quintana Lumangtad guilty beyond reasonable doubt for killing 60-year-old Domingo Timonio after he dropped his earlier plea and entered a guilty plea.
Lumangtad admitted the crime, invoking at least three mitigating circumstances, which includes voluntary surrender, voluntary plea and old age, to lower his penalty by one degree.
Thus, the court, applying only two mitigating circumstances, sentenced him to four years and two months to 10 years of imprisonment.
Court records showed that the respondent killed the victim after he accused the latter of stealing his chickens.
According to a witness, who executed an affidavit, Lumangtad used a bolo to his the victim first in the face then in the back.
The crime happened on July 1, 2011.
He was brought to Paquibato Police Station while the victim was rushed to Southern Philippines Medical Center onboard the barangay's dumptruck.
Timonio was declared dead on July 3, 2011.
The respondent pleaded not guilty when arraigned on August 26, 2011 but withdrew it invoking his mitigating circumstances.
