THE City Prosecutor’s Office (CPO) recommended no bail for two men arrested for selling illegal drugs.
In a resolution, prosecutor Joseph Mamburan charged Ali Gandamasir Imam alias Ali, 44, and Salik Balt Imam alias Salik, 31, with violation of section 5 (Sale, Trading, Administration, Dispensation, Delivery, Distribution and Transportation of Dangerous Drugs and/or Controlled Precursors and Essential Chemicals) of Republic Act 9165 (Comprehensive Dangerous Drugs Act of 2002), and illegal possession of firearms.
Mamburan also charged Salik with violation of Section 11 (Possession of Dangerous Drugs) of RA 9165, while concealing of deadly weapon charges was also filed against Ali.
The two also tested positive for shabu (methamphetamine hydrochloride) use based on the result of urine examination.
"Based on the foregoing, it would appear that respondents might have conspired in selling illegal drugs to the complainant. Their being positive for use of dangerous drugs could be appreciated as qualifying aggravation circumstance," Mamburan said in his resolution.
Court records showed that the two were arrested in a buy-bust operation conducted by the Davao City Police Office-Investigation and Detection Management Branch and Sasa Police Station on August 31.
The team received information that the two are peddling illegal drugs in Veteran's Village, Panacan, Davo City.
Recovered from the possession of Ali were the 0.0795 grams of shabu, .9mm caliber pistol, a disposable lighter, a 8-inches knife, and the P1000 marked money.
The operatives also seized a caliber .22mm revolver, 0.8817 grams of shabu and a motorcycle allegedly used in their illegal drugs transactions.
