THE Davao Regional Trial Court (RTC) is set to issue a warrant of arrest against a New People's Army (NPA) leader and four other members for allegedly killing a soldier.
Court records showed that the existence of probable cause in the rebellion case against Leoncio Pitao alias Parago, Bryan Pitao alias Ryan, Roberto Bustamante Jr. alias Bungot, Porferio Tuna Jr., and one alias Al was clearly established upon examination and evaluation of the resolution of the prosecution.
In a resolution, prosecutor Samuel Atencia found probable cause to charge the respondents based on the complaint of Gina Mansinagan, wife of Army Private First Class Ronel Mansinagan.
Ronel and Special Cafgu Active Auxiliary (SCAA) member Ortega Cariaman were killed in Paquibato District on September 21, 2011.
The respondents allegedly flagged down the motorcycle of the two and gunned them down. The five rebels immediately left the area.
In her affidavit, Gina said his husband was on his way to their detachment from their house around 12 noon when the incident happened.
Gina was just informed the next morning that his husband was killed by the rebels.
No bail was recommended for the respondents’ liberty.
