Hold order sought vs. man in gun raps

THE City Prosecution Office (CPO) filed a motion seeking for the issuance of a hold departure order against the suspect facing charges before the Regional Trial Court (RTC) for robbery and illegal possession of firearms.
Charged with violation of the Presidential Decree 1866 as amended by Republic Act 8294 or the Illegal Possession of Firearms, was Danny Boy Oberez Buscagan, 19, of Punong Lizada in Toril, Davao City.
The accused was earlier charged with robbery, along with Jade B. Garcia and Fedelito C. Algarme, for robbing a gasoline station in Toril on December 22 last year.
Prosecutor Victoriano M. Bello Jr. sought for the issuance of the hold departure order in his resolution recommending for the filing of illegal possession of firearms case against the accused on December 26, 2012.
"In order not to frustrate the ends of justice, as when the accused seeks refuge in another country to escape prosecution and there enjoy the fruits of his crime," Bello said.
He said it is very important that a hold departure order must be issued directing the commissioner of the Bureau of Immigration (BI) to prevent the accused from leaving the country.
Bello found probable cause to charge Buscagan for violation of RA 8294 based on the complaint filed by Senior Police Officer 3 Enrique Ferrando of Toril Police Station.
Based on a resolution, Ferrando was on his way to buy feeds for his fighting cocks, when he saw Buscagan, armed with an improvised shotgun and was chasing a group of youngsters.
The accused was nabbed after he failed to present legal documents for carrying a firearm.
