Car dealer in shooting raps ordered arrested

THE Regional Trial Court (RTC) issued a request letter before the Bukidnon Police Provincial Office (BPPO) Friday for the implementation of the warrant of arrest against a controversial car dealer Lynard Allan Bigcas.

Based on a letter sign by Theresa Montaña–Baluyot, branch clerk of RTC Branch 10, dated January 10, 2013, the head of the Talakag Police Station through the BPPO is requested to facilitate the implementation of the warrant of arrest against Bigcas.

This developed after Judge Virginia Hofileña–Europa, of RTC Branch 11 issued the warrant of arrest against the accused, Bigcas, who is based in Cagayan de Oro City, for the attempted murder case.

Europa signed the warrant of arrest as the pairing judge of Branch 10 since Judge Reterina Fuentes is on her training in Tagaytay City. The court sends the letter before the Talakag Police Station Friday.

Bigcas was charged with attempted murder by lawyer Roberto Mauro Palma Gil, the director of the Housing and Land Use Regulatory Board (HLURB) 11, following their encounter on Mabini Street corner Torres Street on February 18, 2012.

The case was earlier re-raffled and landed to the RTC Branch 10 Judge Retrina E. Fuentes, after Europa inhibited herself from the case, as she was friends of Bigcas and the complainant.

Europa also admits in her order dated January 2, 2013 that she has been a principal sponsor of lawyer Aimee Torrefranca, who was with the accused on February 18.

The City Prosecutor's Office charged Bigcas for attempted murder after finding probable cause on the evidence and statements submitted by the police and the complainant.

Reporters traced on June 5 the update about Bigcas' case filed in Davao City after it was learned in a radio report in Cagayan de Oro that Bigcas has been once again tagged in another shooting incident there.

Bigcas reportedly fired at a certain Michael Turner Allan, 51, an American national, resident of Apartment Door 09 corner Tiano-Gomez Street in Cagayan de Oro City, though he missed his target.
