A LABORER is facing charges before the Regional Trial Court (RTC) for carrying an improvised firearm and a knife following his arrest on January 28.
The accused was identified as Jaylord Gerarcas Toyoda, 22, of Upper Del Carmen in Sasa in Davao City.
Toyoda was charged with violation of Republic Act 9516 or Illegal Possession of Firearms, and Commission on Elections (Comelec) gun ban.
Prosecutor Carlos B. Castaños Jr. found probable cause to charge the accused based on the affidavit/complaint of PO1 Darry M. Deparroco, of Sasa police.
In a resolution issued last January 31, the City Prosecutor's Office (CPO) resolved the case under the Revised Rules of Criminal Procedures as the accused, who opted not to exercise his right to a preliminary investigation, was charged based on the evidence presented by the complainant.
Deparroco and members of his team were conducting patrol along Km. 9 in Sasa when the Central 911 contacted and directed them to validate a report that two notorious groups were about to start a riot at Doña Asuncion subdivision.
The policemen proceeded to the area and saw a group of youngsters rushing towards another group. The policemen were able to prevent the fight and arrested the accused.
Recovered from the possession of the accused were one homemade handgun; one live ammunition of a caliber .45 pistol; and a knife.
Castaños found probable cause to charge the accused.
The suspect is now detained at the Sasa police station. The case will be raffled off on Thursday.
