Brothers accused of murder

TWO brothers are facing charges before the Regional Trial Court (RTC) for killing a woman and causing injuries to her family last month.
The accused were identified as Amore Dairo Misoles, alias Leng, 41, painter, and his brother, Roland, alias Singkaw, of legal age, both residents of Buhangin, Davao City.
The other accused, Juvy Marescal, was already released from jail.
Prosecutor Shahruddin Roberto Sencio Jr. dismissed the case of Marescal for lack of evidence that he committed a crime on January 17, while he found probable cause to charge the two Misoles based on the complaint of the victims.
The complainants were identified as Leoncio Albeos, Jeson Sampan and Donald Equibal, while the slain victim was identified as Leizel, wife of one Jesus Sampan.
The case was filed on February 7 and will be raffled off before the court this Thursday.
In a joint resolution dated on February 6, Albeos was at the house of his daughter on Waling-Waling Street, Buhangin at 1 a.m. when the incident happened.
According to Albeos, the two brothers barged into the house of his daughter, while Marescal left outside to be their lookout, and demanded to call Jesus from his room.
But when Jesus, who was already sleeping with his wife, did not come out, Amore withdraw a bladed weapon and instead, attacked Jason. Roland also joined the attack and stabbed Jeson in his face, neck and other parts of his body.
Leizel woke up due to the noise she heard from their room and tried to pacify Amore, but was instead stabbed to death by the suspect.
Abuse and Equibal ran out of the house but Amore chased them and hit Albeos with an empty bottle of beer on the head while shouting "tiwasan tika" (I'll finish you). Fortunately, he was able to escape.
Meanwhile, Equibal stopped running when he saw Roland pointing a knife to his girlfriend. Roland ran toward Equibal and stabbed him on his head and hand. The two accused were then arrested by the responding policemen.
Sencio said the two brothers were brought before the prosecution for inquest but the latter opted to avail of their right to preliminary investigation submitting their counter affidavits on the matter.
According to Amore, Jesus earlier committed an offense to them, including their family during the fiesta celebration in Buhangin. He added that they didn’t even do anything against the Sampan for them to be maltreated.
"But after going over all the evidence submitted by both parties, still the accused committed a crime," Sencio said.
Charged with slight physical injuries and murder was Amore while his brother was charged with attempted murder.
The accused are now detained at the Buhangin Police Station. (ICT)
