Businessman faces charges

A BUSINESSMAN is now facing charges before the Regional Trial Court (RTC) for allegedly failing to register his business with the Social Security System (SSS).
Charged with violation of the SSS Act of 1997 was Magatingki Alongan Damiano of Jamjoom Cell Parts Marketing whose business establishment is located at G/F Lachmi Shopping Mall on San Pedro Street in Davao City.
Prosecutor Victoriano Bello Jr. found probable cause to charge the accused based on the complaint or affidavit from the SSS filed by its representative and account officer named Aurelia Braceros.
A resolution dated January 24 this year showed that based on record of the case filed by the complainant against the accused, Damiano ailed to register his business with SSS and yet he required his employees to obtain the kind of benefit.
"Considering the employer or the accused still failed to register its business but require the matter to his employees, the SSS through its Division Legal Unit on August 2, 2012 served a demand letter to the accused so as to address the concerned issue," Bello said in his resolution.
Bello said the prosecution issued a subpoena before the accused last September 4, yet the office did not receive answer from Damiano, thus the charge filed against him was resolved under pursuant to the Revised Rules of Command Procedure.
Bello found probable cause to charge the accused for violation of Section 9 (Coverage) in relation to Section 24 (Employment records and reports) as punishable under Section 28 (Penal clause) of the SSS Law.
