CHARGES have been filed against a truck driver before the City Prosecutor's Office for reckless driving.
The accused was identified as Crecencio Delima Ofamin, 52, resident of Palique Hagonoy in Davao del Sur. He was charged for reckless imprudence resulting to death and damage based on the Revised Penal Code (RPC).
A source, who refused to be named for lack of authority to speak, said the accused was brought before Prosecutor Oliver Saniel on Thursday at around 8:30 a.m. for inquest proceeding.
It can be recalled that a road accident occurred in Binguao, Toril on March 13 at around 2 a.m. wherein one Renato Salada Pardillo, 35, motorcycle driver, of Greenville Calimpang in General Santos City, died on the spot, after he hit a parked truck.
Based on the investigation conducted by SPO1 Celso Halasan of Toril Police Station, the victim was heading to Davao City when he bumped on the rear portion of the truck of the accused, which was parked on the road.
It was learned that the said truck had a mechanical failure so it was parked on the road. But according to the accused, he has displayed an early warning device with a small flame so as to avoid an accident on the road.
But the warning device especially the flame which was only placed inside a small can was not visible to those approaching vehicles thus, the driver was charged.
The body of the victim was brought to Villa Funeral Parlor in Toril, while the accused is now detained at the Toril Police Station for his proper disposition.
