A MAN is facing charges before the Regional Trial Court (RTC) for allegedly molesting his nine-year-old goddaughter in separate occasions last year.
Facing four counts of acts of lasciviousness is “Edward” for allegedly molesting his goddaughter “Ivy” (identities withheld for the welfare of the victim).
Prosecutor Serafica Justiniani-Weis has found probable cause to charge Edward based on the complaint filed by the mother of the victim.
The mother of the victim, “Malena”, in her affidavit, said she discovered that her daughter was molested last January 22, 2012, when her neighbor asked her if it was indeed true that Edward had abused Ivy. Malena then asked Ivy about the inquiry of her neighbor and the latter confessed that Edward indeed harassed her.
Ivy, meanwhile, cited in her affidavit that she was molested in four separate occasions. The first incident happened last December 11, 2011 where she mentioned that Edward touched her breast while they were riding the motorcycle. On the second week of January 2012, Edward allegedly raised her school uniform and sando and started kissing her breast while they were within the school campus.
Last January 21 of the same year, Edward allegedly touched her breast and private parts while they were bathing in a nearby river. Ivy also cited that Edward took some nude photos of her after they bathed in the river.
Malena then reported to the barangay officials and they were summoned along with Ivy and Edward. The official tried to mediate the dialogue between the aggrieved party and Edward but Malena refused to settle with the accused.
Malena filed a complaint at the Women and Children's Protection Desk yet she was not able to submit the birth certificate of Ivy and in turn the case was not investigated. Thus, the charges were then filed before RTC and is awaiting for the raffle to determine which branch will handle the case. (Sun.Star Davao)
