Collector sued for failure to remit payments-A A +A

CHARGES have been filed before the Regional Trial Court of Davao against a man who failed to remit to his employer the rental payment entrusted to him and for falsifying documents in 2010.
Facing charges for qualified theft and falsification of documents under the Revised Penal Code is Phillips Carl Albonia Rodaje, of Padada, Davao del Sur, and a leasing officer of Alsons Development and Investigation Corp.
Rodaje was charged based on the complaint filed by Eric dela Costa, general manager of Alsons.
Dela Costa, in his affidavit, said Rodaje was the leasing officer responsible for collecting the lease payments of their clients at Aldevinco Shopping Center and City Triangle.
He cited that in April 2010, their office conducted a first quarter audit and he found out that they incurred P155,425 loss coming from the transactions from seven different tenants handled by Rodaje.
The tenants cited in their audit included a P7,500 loss from one Emma Petacorin, P9,600 from Alex Laput, P17,550 from Janet Sanggutan, P8,500 from Joven Pascua, P76,000 from Michelle and Erwin Cabania, P8,775 from Nimrod Malnegro, and P28,000 from Panwiches stall at City Triangle.
The complainant contacted their tenants and each of them confirmed that they have already paid their respective rental fees to Rodaje.
The tenants also presented their respective official receipts issued by Rodaje.
Upon matching the official receipts and the copy of the receipts submitted by Rodaje to the accounting department of the company, dela Costa discovered numerous discrepancies indicating that the amount of payment that Rodaje remitted to the company was not the full payment given by the tenants.
After he was informed of his offense, Rodaje sent a formal letter to the company admitting his fault and vowing to pay for the losses.
On May 14 of the same year, dela Costa sent Rodaje a notice demanding to pay for the incurred losses, but the respondent failed to do so, thus the filing of charges.
