Man charged for punching cop, threatening man-A A +A

CHARGES were filed before the Municipal Trial Court in Cities (MTCC) against a man who punched a police officer and threatened to kill a man last September 14 at Las Arenas, Barangay Mandug, Buhangin, Davao City.
Facing direct assault and light threat charges is Norman Emproc Lapedan, of legal age, from Purok Silad, Barangay Mandug.
Prosecutor Panfilo Lovitos found probable cause to charge Lapedan based on the complaint filed by Police Officer 3 Marcial Taguic of Buhangin police and private complainant Rolando Tabaquin.
Tabquin, in his affidavit, said that while he and his wife Josephine parked their Suzuki Multicab in front of their house, they were approached by the suspect, who was under the influence of alcohol, whom they ignored.
As they made their way inside their house, Lapedan followed and said, "Palag kaayo ko sa inyoha! Pusilon tika! Buakon nako inyong ulo (I am angry at you. I will shoot you and crack your skulls)!"
The complainant sought assistance from Buhangin police, who sent Taguic along with Senior Police Officer 1 Wildredo Andrino.
Taguic, in his complaint, said they chased the suspect and when they caught up with Lapedan, the latter punched him on the face. After he was subdued and was about to be handcuffed by the police officers, Lapedan again put up a struggle and damaged the uniform of Taguic.
Bystanders helped the policemen restrain Lapedan.
Lovitos, in his two-page resolution, said there was no probable cause to charge Lapedan with grave threats as he merely uttered the threatening words with no corresponding actions. Thus, he reduced the charge from grave threat to light threat. But Lovitos affirmed the direct assault charge based on the evidence presented by Taguic.
Lapedan is currently detained at Buhangin Police Station and he will have to post a P20,000 bail-bond for his temporary release.
