A PANEL has been created to look into formal charges recommended against erring employees of the City Treasurer's Office (CTO).
City administrator Melchor Quitain said the investigating panel is composed of lawyers Jhopee S. Agustin and Tristan Dwight P. Domingo and chaired by City Legal Office (CLO) head Osmundo Villanueva Jr.
"Yung ginawa last time was more on a fact-finding investigation, but this time it's more on a formal investigation of a formal complaint," Quitain said in an interview.
He said "multiple" administrative charges and preventive suspension were recommended against the CTO employees, whom the City Government refused to identify pending investigation.
Lawyer Marissa Marasigan-Torentera of the CLO said initial investigation found probable cause against these employees for grave misconduct and dishonesty.
CLO has been looking into the P8 million unremitted taxes at the CTO.
The three lawyers -- Agustin, Domingo, and Villanueva -- also composed the investigating committee that Mayor Rodrigo Duterte created to conduct administrative proceedings relative to the complaints made against employees of the City Government of Davao.
"In his desire to put into place an effective and impartial system to conduct proper administrative proceedings to address complaints made against city government of Davao employees, the city mayor recognizes the need to create an investigating committee," read the Executive Order (EO) No. 37, which Duterte inked on October 18.
Based on the EO, the investigating committee is tasked to "conduct a preliminary investigation to determine the existence of prima facie case to warrant the filing of a formal charge; conduct conferences to profound on clarificatory and relevant questions, summon all parties concerned and/or issue notices, subpoena duces tecum, subpoena ad tetificandum, show-cause memoranda and other lawful processes to appropriate individuals relative to a complaint filed against an employee; submit to the city mayor an investigation report with recommendation and the complete records of the case; conduct formal investigation and submit the findings and recommendations to the city mayor; and perform other functions that the mayor may further assign."
Further, Duterte appointed special prosecutors, who will prosecute all administrative actions subject to an affirmative vote of the investigating committee.
Lawyers Enrique J.A. Bonocan and Gil Norman D. Ciudadano are the lead special prosecutor and alternate special prosecutor, respectively. (Arianne Caryl N. Casas)
