THE lady barangay election bet who is the subject of a lewd photo scandal filed a petition for protection order before the Regional Trial Court (RTC) in Davao Tuesday.
The complainant, identified as “Marina” (true identity withheld for the victim's protection), along with her legal adviser lawyer Ranoelo Leonar, appeared before the RTC Office of the Clerk of Court (OCC) around 11:30 a.m. Tuesday to file a petition for protection order against the incumbent barangay official that she accuses of being behind the circulation of the photo.
"Gihangyo namo ang court nga mag-issue ug order na ipa-stop ang harassment sa victim ug ipa-surrender tong camera nga gigamit sa court ug ipa-delete sa atubangan sa court kung unsa man ang naka-record sa picture (We asked the court to issue an order to stop the harassment on the victim and to surrender the camera used and have whatever was recorded in the picture deleted before the court)," Leonar told reporters on Tuesday.
The victim's legal adviser said they were urged to file a petition for protection order as they have received reports that some people were still spreading videos Monday night. He also said that they prioritized the protection order as it is a prerequisite in filing charges against the barangay official for violation of the Republic Act (RA) 9262 otherwise known as the Anti-Violence Against Women and Children (VAWC) Act of 2004.
"We first petitioned for the temporary protection order since the continuous spread of the videos is causing further damage to the victim,” Leonar said, adding they are also waiting for the counter-affidavit of the accused before we file the case before the City Prosecutor's Office.
Marina, meanwhile, told reporters: "Nakaapekto gyud ni sa akong kandidatura, pero maybe, it's not my time. Pero nagpasalamat ko kay nahitabo ni (This affected my candidacy, but maybe, it's really not my time. But I'm thankful this happened)."
"Kabalo ko na dili lang ako ang iyang gi-ingani. Ako lang ang start and I will fight (I know that I'm not the only who has been treated like this. I will be the start and I will fight)," she said.
Marina is also set to file slander charges against the accused.
The accused, on the other hand, vehemently denied the accusation against him, as he claims that he did not spread the photos and that his rivals in the barangay polls are just using the victim to destroy him.
He told Sun.Star SuperBalita that he is poised to file libel charges against the people who accused him of spreading the scandalous photos.
