A GUARD who was arrested for alleged grave threat was released on Friday, after the victim did not push through with filing his formal complaint against him before the City Prosecution Office (CPO).
Police identified the accused as Roberto Celisteno, 57, a security guard of IT Park Res. in Talomo in Davao City. The complainant was identified as Sherwin Butad Beleson, 33, a construction worker of the IT Park Residence, and resident of Matina.
Superintendent Julius Silagan, chief of Talomo Police Station, said the accused was released after the complainant refused to file charges of grave threat under Revised Penal Code (RPC) against him.
Silagan added that the complainant appeared before their station around 2 p.m. Friday, with the Construction’s Human Resource (HR) representative named Winston Hibaya, of Davao City, to settle the issue.
Record showed that the accused was arrested at IT Park last December 5 around 10:50 p.m. when he pulled out his gun intended to shoot the complainant, but accidentally shot himself, hitting his index finger.
The complainant, who was with one Mervin, entered the construction site for business. A confrontation ensued between the victim and the guard, when the latter asked him to close the gate.
The suspect said the victim and his friend Mervin challenged him to a fistfight, prompting him to pull out his gun.
Police recovered from his possession a homemade revolver pistol with serial number 1069898, loaded with three live ammunition.
