City court extends TPO for woman in lewd photo-A A +A
Tuesday, February 11, 2014
THE temporary protection order (TPO) for the lady barangay council member candidate, who was subject of lewd photos allegedly circulated by a former barangay chief, was extended to 30 more days after its renewal last February 5.
The complainant only identified as Marina (true identity withheld for security purposes), through her legal counsel Ranoelo Leonar, said the Regional Trial Court (RTC) Branch 33 Judge Lope Callo extended the TPO and scheduled the next hearing on March 5, as the prosecution has yet to complete its testimony and presentation of evidence.
"In our hearing last February 5, we petitioned for the extension of the TPO since we are not done with the presentation of evidence. So far, we have already presented two witnesses and hopefully on the next hearing, the complainant herself would testify before the court," Leonar said over the phone.
He said the first witness, who is the best friend of the complainant, told the court that she received a set of lewd photos at her residence in Kabacan. Those photos served as warning for the complainant but it was too late for the witness to warn Marina as the photo circulated on the eve of the barangay polls on October 25, 2013.
The other witness identified as Jojit Gallano, meanwhile, attested that the photos were circulated in four subdivisions in barangays 10-A and 9-A.
Gallano told the court that he saw motorcycle-riding men throwing copies of the lewd photos at the garages of the residences and the sidewalks in the two barangays.
"The complainant will be testifying before the court hopefully on the next hearing and she will be able to cite circumstances from where she could prove that it was Robert Olanolan who took the picture and caused its circulation. We will also petition for a physical examination on Olanolan to prove that it was his private part that was seen in the picture," Leonar said.
He added that aside from the complainant, they may also present another witness before the court. (Sun.Star Davao)
