Gun raps filed vs 3 men in buy-bust-A A +A

THE City Prosecutor’s Office (CPO) affirmed the charges filed against three men arrested for selling firearms and ammunitions to police officers during a buy-bust operation at Barangay Lacson in Calinan, Davao City on Feb. 13.
Prosecutor Oliver Saniel found probable cause to charge Sunny Amar Fernando, Joemar Bantac Celestial and Osias, Anas Amar, all residents of Arakan, North Cotabato for violation of the Republic Act 10591 or the Comprehensive Firearms and Ammunition Regulation Act based on the complaint filed by the Criminal Investigation and Detection Group (CIDG).
Senior police officer 1 (SPO1) Frances Maningo, PO3 Giovanni Javier and PO3 Faustino Openda, in their joint affidavit, said they arrested the three after they handed out three homemade 12-gauge shotguns worth P10,000 to the operatives.
Also recovered from their possession were three magazines and two shotgun ammos.
Celestial and Amar contended that it should only be Fernando who should be charged as he was the only one who dealt with the police.
But Saniel, in his resolution, said: "Although it was only Fernando who actually dealt with the police poseur buyer, respondents Celestial and Amar's act of detaching the sack from the motorcycle where the shotguns were placed and opening the same thereby revealing to the poseur buyer the said firearms are enough to show that indeed, the said respondents are aware of the transaction and are part of the conspiracy to sell the shotguns."
Saniel also filed a motion for the issuance of a hold departure order against the three to prevent the latter from going out of the city or the country.
The case is still with the Regional Trial Court Office of the Clerk of Court (RTC-OCC) and is set to be raffled off to a branch of RTC on Thursday.
