Court orders release of stolen vehicle to bank

A REGIONAL Trial Court (RTC) in Davao City ordered the release of one the vehicles seized by the Regional Highway Patrol Unit (RHPU)-Davao in a string of anti-carnapping operations in Davao City in 2012 in favor of a bank.

RTC Branch 10 Judge Retrina Fuentes ordered the release of the Nissan Frontier Navarra with serial no. CVLULTYD40A07636 and engine number YD254230631 to RCBC Savings Bank.

This after Fuentes acknowledged the motion and manifestation filed by RCBC Savings, which presented documents proving that they are the mortgagee of the vehicle.

"Claimant adequately proved that they are the mortgagee of a Nissan Frontier Navara by the submission of a promissory note with chattel mortgage and the same is not, in any way, involved in any illegal activities considering that that no case was filed involving the subject vehicle," Fuentes said in his ruling.

She also said there was no objection from RHPU-Davao thus, they are ordered to release the vehicle.

But while the Nissan vehicle is set to be released, a Pampangeña businesswoman identified as Odessa Recto Tiu and the East West Bank are still in a legal battle over ownership of a Toyota Hilux with plate number UOS461.

Tiu claimed that she is the rightful owner of the vehicle after she was granted a car loan by the East West Bank.

The latter, however, contested her ownership as they cited that Tiu had not been paying his monthly amortization and that she had not shown any intent to continue her payment. (Ruji Peter S. Abat)
